Welcome to Spousey! These Terms of Service ("Terms") govern your use of the Spousey mobile application and website located at Spousey.ai (collectively, the "Service"). By accessing or using Spousey, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using Spousey, you confirm that you:

  • Are at least 18 years old
  • Have the legal capacity to enter into these Terms
  • Agree to comply with all applicable laws and regulations
  • Accept these Terms in full

If you do not agree to these Terms, please do not use Spousey.

2. Description of Service

Spousey is a mobile application designed to provide automated relationship coaching services. The Service may include:

  • AI-powered relationship guidance and coaching
  • Personalized relationship insights and recommendations
  • Communication tools and exercises
  • Relationship assessment and tracking features
  • Other features as we may add from time to time

3. Account Registration

3.1 Account Creation

To use certain features of Spousey, you must create an account. You agree to:

  • Provide accurate, current, and complete information
  • Maintain and update your information to keep it accurate
  • Keep your password secure and confidential
  • Notify us immediately of any unauthorized use of your account

3.2 Account Responsibility

You are responsible for all activities that occur under your account. Spousey is not liable for any loss or damage arising from your failure to protect your account credentials.

4. Subscription and Payment

4.1 Subscription Plans

Spousey offers a paid subscription plan at $49.99 per month.

4.2 Payment Terms

  • Subscription fees are billed in advance on a monthly basis
  • All fees are non-refundable except as required by law
  • We reserve the right to change our fees with 30 days' notice
  • You authorize us to charge your payment method for all fees
  • All applicable commissions, processing fees, and platform fees (such as Apple App Store or Google Play Store fees) are passed on to you and will be added to the base subscription price at checkout

4.3 Free Trials

If we offer a free trial, we will charge your payment method when the trial ends unless you cancel before the trial period expires.

4.4 Cancellation

You may cancel your subscription at any time through your account settings or by contacting us at Support@spousey.ai. Your subscription will remain active until the end of your current billing period.

5. Acceptable Use Policy

You agree NOT to use Spousey to:

  • Violate any laws or regulations
  • Infringe on intellectual property rights
  • Transmit harmful, threatening, abusive, or harassing content
  • Impersonate any person or entity
  • Interfere with or disrupt the Service
  • Attempt to gain unauthorized access to the Service
  • Upload viruses, malware, or other malicious code
  • Collect information about other users without permission
  • Use the Service for any commercial purpose without our consent

6. User Content

6.1 Your Content

You may be able to submit, post, or share content through Spousey ("User Content"). You retain ownership of your User Content, but you grant us a license to use it.

6.2 License to Us

By submitting User Content, you grant Spousey a worldwide, non-exclusive, royalty-free license to use, copy, modify, distribute, and display your User Content solely for the purpose of operating and improving the Service.

6.3 Content Responsibility

You are solely responsible for your User Content. You represent that:

  • You own or have the necessary rights to your User Content
  • Your User Content does not violate these Terms or any laws
  • Your User Content does not infringe on anyone else's rights

6.4 Content Removal

We reserve the right to remove any User Content that violates these Terms or that we find objectionable, without notice.

7. Intellectual Property

7.1 Our Rights

Spousey and all of its content, features, and functionality (including but not limited to software, text, graphics, logos, and images) are owned by Spousey Inc or our licensors and are protected by copyright, trademark, and other intellectual property laws.

7.2 Restrictions

You may not:

  • Copy, modify, or create derivative works of the Service
  • Reverse engineer or attempt to extract source code
  • Remove any copyright or proprietary notices
  • Use the Service in any way not expressly permitted by these Terms

8. Privacy

Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your personal information. By using Spousey, you agree to our Privacy Policy, which is incorporated into these Terms by reference.

9. Third-Party Services

Spousey may contain links to third-party websites or services that are not owned or controlled by us. We are not responsible for the content, privacy policies, or practices of any third-party services. You access third-party services at your own risk.

10. Disclaimers

10.1 No Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT:

  • The Service will be uninterrupted, secure, or error-free
  • The results obtained from using the Service will be accurate or reliable
  • Any errors in the Service will be corrected

10.2 Not Professional Advice

Spousey is not a substitute for professional relationship counseling, therapy, or medical advice. The Service provides general information and tools only. Always consult with qualified professionals for specific advice.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • SPOUSEY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
  • OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY
  • SOME JURISDICTIONS DO NOT ALLOW LIMITATIONS ON LIABILITY, SO THESE LIMITATIONS MAY NOT APPLY TO YOU

12. Indemnification

You agree to defend, indemnify, and hold harmless Spousey, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including attorney's fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any rights of another person
  • Your User Content

13. Termination

13.1 Termination by You

You may stop using the Service and delete your account at any time.

13.2 Termination by Us

We may suspend or terminate your account and access to the Service at any time, with or without notice, for:

  • Violation of these Terms
  • Illegal or harmful behavior
  • Any reason at our sole discretion

13.3 Effect of Termination

Upon termination:

  • Your right to use the Service immediately ceases
  • We may delete your account and User Content
  • Sections of these Terms that should survive termination will remain in effect

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

  • Posting the updated Terms on Spousey.ai
  • Sending you an email notification
  • Displaying a notice in the app

Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.

16.5 Force Majeure

We are not liable for any failure to perform due to circumstances beyond our reasonable control.
